Is freelancing legal with a job in India? Moonlighting rules

Want to freelance alongside your job in India? What the law says, what Infosys and TCS allow, how to read your contract, and how to declare both incomes.

Wondering whether you can take freelance work while you have a job in India, or whether it could get you into legal trouble? Freelancing itself is legal in India, and for most people in private companies no law stops them earning money on the side. What decides whether you can do it is your own employment contract and your company's policy, so your offer letter matters more than any law. Government employees are the exception, because they need permission before taking any outside work. This is general information from published sources and from what I have seen in people I coach, not legal advice.

Why companies get nervous about moonlighting

Moonlighting means doing paid work outside your main job, whether that is a second job or freelance projects in the evenings. In September 2022, Infosys sent its employees an email with the line "No two-timing, no moonlighting", and warned that breaking the rule could lead to termination.2 A month later, TCS said its employment contract does not allow employees to work for any other organisation.4

Then, in October 2022, Infosys allowed gig work after all, as long as the employee asks their manager and HR first, does the work in their personal time, and works only for companies that do not compete with Infosys or with Infosys's clients.3 Those conditions show what most employers actually worry about. They are not afraid that you will earn more. They are afraid you will work for a competitor, take their clients, use their time and their data, or come to work tired.

The fear on the employee's side is a different one, and a growth marketer I spoke with this year described it plainly: people in corporate jobs want a backup income, but they worry that the company will find out and take legal action against them. That worry stops many people before they have even read their own contract.

The law allows it, and your contract decides

India has no general law against freelancing on the side. The few legal limits on working two jobs were written for factory workers and for shop staff under some state laws, not for someone in IT or services taking projects in the evening.1 For everyone else, the rule comes from the contract. The Supreme Court put it this way: an existing contract of service "is a bar to service with another master unless the contract otherwise provides or the master consents".1 So if your offer letter says you cannot take other work without permission, that clause holds while you are employed. If it says nothing, or allows outside work with consent, you have room.

In my experience, many companies do not allow you to work for a competitor or to take a second full-time job, but they do allow private work such as small contracts or part-time projects. The answer for your company is usually written down, in your offer letter or in an HR policy.

Experimenting is not illegal. Doing side projects is not illegal. They need to understand their contract or take risk.

What to do before you take your first project

Find your line in writing. Go through the papers you signed when you joined, and your company's HR policy, until you find the sentence that covers outside work. Look for the words "other employment", "conflict of interest", "consent" and "intellectual property". The guide to freelancing while working full time lists the clauses to check and the lines that employers usually draw.

Ask when the wording needs permission or is unclear. If the contract says outside work needs consent, ask your manager or HR, and ask in writing so that the answer is on record. If you work for the government, the conduct rules say you need sanction before taking any other employment or doing private work for a fee, so ask first.5

Declare both incomes when you file. Your salary and your freelance income are both taxed under your PAN. Once you have income from freelancing, you can no longer file the simple ITR-1. People with salary and freelance income usually file ITR-4 if their professional income is under the presumptive scheme and their total income is within ₹50 lakh, and ITR-3 otherwise.6 Your employer deducts tax only on your salary, so the tax on your freelance income may need to be paid as advance tax if it comes to ₹10,000 or more in a year.7 The GST and income tax guide covers GST and the presumptive scheme, and a CA can confirm which form fits you.

Make the decision yours. After you read the contract or speak to HR, the answer may be clear, or it may leave you with a hard choice between the security you have and the work you want to try. If you are still weighing whether freelancing pays enough to be worth that choice, is freelancing worth it in India? is an honest answer with numbers. Either way, you are the one taking the risk, so you are the one who should decide, with the facts in front of you rather than the rumours.

This week

  1. Find your offer letter and your company's policy on outside work, and highlight anything about other employment, conflict of interest, consent and intellectual property.
  2. Write down the clients you would want and cross out any that compete with your employer or are your employer's clients.
  3. If your contract asks for consent, draft the email to HR describing the work, the hours and the kind of clients, and send it before your first project.
  4. Open a separate folder for freelance invoices and payment records, so that filing two incomes next July is straightforward.
